  Terms & Conditions of Web Site Use

 

Please read this Agreement carefully as it governs your use of the HobbyCraft website - www.hobbycraft.co.uk - (the 'Site'). By continuing to use our Site you are agreeing to the terms set out below. If you are under 18 years of age, you should ask your parents to check these terms before proceeding any further. 1. Provision of Website Service

The Site is owned and operated by HobbyCraft Group Ltd (Company number 806269), ("HobbyCraft") whose registered office is at 7 Enterprise Way, Aviation Park, Bournemouth International Airport, Christchurch, Dorset BH23 6HG, UK; place of registration - England. VAT number 185 305 756.

 

 

2. Limited Rights to Use Content

2.1 All material including any intellectual property in it displayed on the Site ("Content") belongs to HobbyCraft or its suppliers. Subject to section 2.2, we give you the right, for your own personal or non-commercial purposes only to:

• retrieve and display the Content on your PC screen

• print individual pages on paper

• store individual pages in electronic form on disk/CD

You do not have the right to store any Content on any server or other storage device connected to an external network or make any other use of the Content.

2.2 Most of the Content is owned by HobbyCraft but certain Content is used with the permission of third parties ("Third Party Content") and may be subject to additional restrictions. These restrictions and/or intellectual property rights will be highlighted through hyperlinks on the appropriate pages. You must comply with such restrictions and/or copyrights.

2.3 You may not, without prior written permission from HobbyCraft given within the previous 6 months:

• redistribute any of the Content or supply it to other people;

• remove the copyright or trade mark notices from any copies of Content made under this Agreement;

• create a database in any form (including electronic or structured manual form) by downloading, copying and storing all or any of the Content;

• except as expressly set in this Agreement, modify, reproduce or in any way use any of the Content.

 

 

3. Participation

3.1 HobbyCraft allows you to submit material to certain areas of the Site. HobbyCraft reserves the right to delete, move and edit any material submitted. You are solely responsible for the material you submit to the Site and by submitting any material you agree that you will not submit any material that:

• advertises or promotes any goods or services deemed to be in competition with HobbyCraft;

• reveals any confidential or sensitive information;

• contains or links to any unlawful, threatening, abusive, libelous, indecent or otherwise illegal material;

• contains any material which you do not have permission to use (including material which may be protected by copyright, trade marks, database rights or any other form of intellectual property right);

•contains viruses or any other components with harmful or contaminating properties which may affect the Site or any equipment connected to it; or

• disguises your identity or impersonates any person or entity, including, but not limited to, a HobbyCraft employee, or falsely claims or otherwise misrepresents your affiliation with a person or entity.

3.2 HobbyCraft welcomes your comments, suggestions, ideas and other material you provide or send directly to us. By submitting material to the Site, you grant HobbyCraft a perpetual royalty free, non-exclusive licence to reproduce, modify, translate, make available, distribute and sub-licence any material you submit in whole or in part or in any form. You agree that you waive any moral rights you have in the material.

3.3 The Site contains material and content submitted by persons ("Users") over whom HobbyCraft has no control. HobbyCraft cannot guarantee the accuracy, integrity or quality of any such material. Some Users may breach these terms and post material that is misleading, untrue or offensive - you must bear all risks associated with and resulting from your viewing of such material.

3.4 Copyright of any software that is made available for download for the participation in the Site ("Software") belongs to HobbyCraft, its suppliers or Third Parties. Your use of the Software is governed by the terms of any licence agreement that may accompany or be included with the Software. Certain pages on the Site may also be subject to additional terms of use that will be made available clearly by hyperlink - you must comply with all such terms.

   
 

4. Purchases

4.1 The prices for goods displayed for sale on the Site are as set out on the Site and are inclusive of VAT. Where additional charges are made for delivery, they are clearly displayed. Prices and delivery charges displayed are valid and effective only in the United Kingdom.

HobbyCraft cannot accept your order until you have paid for it in full (including applicable delivery charges). Upon payment, we will confirm acceptance of your order by e-mail which will be sent to the e-mail address you provide on your order details. Whether or not you receive an e-mail, our acceptance of your order will create a legally binding contract between us. We reserve the right not to supply you at our discretion.

4.2 Credit and debit card payments

All card payments are processed by QBaroo using the Protx gateway.

4.3 Your right to cancel your order

Your right to cancel your order - You may cancel your order at any stage before the expiry of the period of 7 working days beginning with the day after the day on which you receive the goods or at any stage before the goods are delivered.

If you wish to cancel your order up until the point your order is despatched to you or a third party, you can either call us on 01202 596100 and ask for online gift voucher sales or email giftvouchers@hobbycraft.co.uk

Please note, if you cancel your order and the goods have been despatched to you/received by you, you will be required to return the goods via Royal Mail secure delivery services as follows:

Orders upto £30 - please return via Recorded Delivery
Orders over £30 and up to £200 - please return via Special Delivery

4.4 Returns & refunds

Please note refunds cannot be given on gift vouchers.

   
 

5. Limited Warranties

HobbyCraft will use its reasonable skill and care in making sure that the Site is available to you on a continual basis. However, because of the number of sources from which HobbyCraft obtains the Content and because of the nature of the Internet, HobbyCraft does not give you any other warranties. In particular, you should not take the accuracy or availability of the information for granted and HobbyCraft makes no warranty that the Site is free from infection by viruses or anything else that has contaminating or destructive properties.

   
 

6. Limitation of Liability

In respect of the Content that is available on the Site, HobbyCraft will use its reasonable endeavours to resolve faults. You agree that hobbycraft.co.uk will not be liable for any losses (other than damages for death or personal injury resulting from HobbyCraft's negligence) you may incur as a result of your use or non-use of that Content.

   
 

7. Subscribing to our mailing list to receive "Crafty News" our email newsletter

Our site's registration form requires users to give us their contact information (e.g. name and email address) in addition to some demographic information (e.g. postcode). If you request to receive information from HobbyCraft, we will use customer contact information from the registration form to send you electronic newsletters or similar types of information.

   

8. Privacy Policy

8.1 HobbyCraft is committed to protecting the privacy of those using our Site. The information that you provide about yourself to HobbyCraft will only be used by HobbyCraft in accordance with its Privacy Policy as set out below.

By using our website, you consent to the collection and use of personal information by HobbyCraft. If we decide to change our privacy policy, we will post changes on this page so that you are always aware of what information we collect, how we use it and under what circumstances we disclose it.

8.2 Personal Information

We never make your personal details available to companies outside HobbyCraft for marketing purposes, although our representatives and agencies may hold your data so that your details can be kept up to date, your orders processed and emails sent on behalf of HobbyCraft.

The only time personal information is collected by HobbyCraft is for the purposes of the purchasing gift vouchers from the website or subscribing to Crafty News, our email newsletter.

If you sign up for Crafty News, our email newsletter, we use the personal information we collect about you to send you email newsletters featuring the latest promotional news, demonstrations and in store activity information. This information is held in compliance with the Data Protection Act 1998.

Personal information is also used for shipping gift vouchers to customers in respect of purchases made by them or for them for sending confirmation details for those purchases to the customer making the purchase and for processing orders and payments. HobbyCraft uses third parties to assist with this who have access to personal information needed to perform their functions but may not use it for other purposes.

8.3 Unsubscribing

If at any time you want to know what information HobbyCraft holds about you, please feel free to contact us and we will provide you with details of all the information we hold about you. If you want to remove the information at any time, please let us know and we will remove it straight away.

If you have previously registered to receive our email newsletters you can remove your email address from the list by using the links in the emails we send you.

8.4 At some point in the future we may wish to provide statistics about our customers, traffic patterns and related site information to reputable third parties, however the information will not include any personal customer information or identify individual customers.

 
 

9. Cookies

9.1 A cookie is a small data file that certain websites write to your hard drive when you visit them. A cookie file can contain information such as a user ID that the site uses to track the pages you have visited. The only personal information a cookie can contain is information you supply yourself. The information stored by one site into a cookie cannot be read by another website.

9.2 We use a cookie so you view our pop-up window only once, the first time you visit hobbycraft.co.uk. We also use cookies to store details required for the purchase of gift vouchers online.

Cookies may be disabled in the customer's web browser, although this may affect usability of the site especially the sale of online gift vouchers.

HobbyCraft is continually seeking to improve the Site and services offered. HobbyCraft reserves the right, at its discretion, to make changes to any part of the Site.

The Site contains links to other websites and resources. HobbyCraft will make clear where such links are being made. Independent third parties provide these sites. HobbyCraft is not responsible and shall not be liable for the availability or content of these outside resources. Please be aware that HobbyCraft is not responsible for the privacy practices of other sites. We encourage our users to be aware when they leave our site and to read the privacy statements/terms and conditions of every website. The privacy policy highlighted in section 8 applies solely to information collected by HobbyCraft.

   
 

12. Surveys & Competitions

From time-to-time our Site requests information from users via surveys, free prize draws or competitions. Participation in these activities is completely voluntary and the user therefore has a choice whether or not to disclose this information. Information requested may include contact information and demographic information (name, address, post code, age group). Contact information will be used to notify the winners and award prizes. Winners' names and other relevant material will be published on the web site. Survey information will be used for purposes of monitoring or improving the customer experience and satisfaction of the Site and of HobbyCraft superstores.

   
 

13. Security & E-commerce gateway

Your security and peace of mind are of the greatest importance to HobbyCraft. We endeavour to take all reasonable steps to protect your personal information.

Any sensitive data (including personal data and payment information) you send to us from your computer is securely encrypted and protected using Internet standard encryption technology known as SSL (Secure Sockets Layer.) This process scrambles any sensitive data you transmit to us, preventing it from being intercepted during transmission.

Our e-commerce provider is QBaroo. Our e-commerce site address is www.qbaroo.com/hobbycraft. Neither QBaroo nor HobbyCraft store credit card details on their respective servers. Your credit card information is discarded when your order is placed.

15. General

15.1 There is no specific time limit applying to your access and use of the site. However, hobbycraft.co.uk reserves the right to suspend or terminate your access and use at any time. It may exercise the right with or without notice.

15.2 You may not assign, sub-licence or otherwise transfer this Agreement or your rights of access to the Site.

15.3 Failure by either party to exercise any right or remedy under this Agreement does not constitute a waiver of that right or remedy.

15.4 A person who is not party to this Agreement shall have no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any of its terms.

15.5 English law will apply to this Agreement and both you and HobbyCraft agree to submit to the non-exclusive jurisdiction of the English Courts.
